1. General
The vizitly.cloud Service provides online booking, marketplace, calendar, widget and QR tools for businesses, service providers and lodging properties (the Business). Using the Service means you accept these terms and the privacy policy.
2. Owner account
Registration requires accurate contact details. You are responsible for keeping your password confidential. We may suspend an account in case of terms violations, fraud or security risks.
3. Contract between guest and Business
A booking made by an end guest for the Business creates legal relations for the service (e.g. appointment) or stay primarily between the guest and the Business. The Service acts as a technical booking and marketplace platform, unless an agreement with the operator says otherwise.
4. Fees, commission and deposit
Fees for commission or premium features may be charged as shown in the dashboard or Service notices. Card and other payments may be handled by Stripe under Stripe’s terms. For lodging bookings the Business may require a deposit by bank transfer to its own account; Vizitly does not intermediate such transfers or hold guest funds.
5. Business content and data
The Business is responsible for the lawfulness of service and property descriptions, prices, media and personal data of staff and guests it enters. Unlawful, misleading or third-party-rights-infringing content is prohibited.
6. Limitation of liability
The Service is provided “as is” within the limits allowed by law. We are not liable for outages beyond our control (e.g. provider failures, force majeure) or for indirect damages except where mandatory law requires otherwise. We are not liable for the quality of the service or stay delivered by the Business to the guest.
7. Changes to the terms
We may change these terms for important reasons (law, security, product development). Material changes will be announced in the Service (e.g. dashboard or site notice). Continued use after changes take effect may constitute acceptance unless law requires separate consent.
8. Final provisions
The agreement with the Service operator is governed by Polish law unless otherwise agreed in writing. Disputes shall be resolved by the court competent for the controller’s seat, subject to mandatory consumer protection rules for individual consumers.
